GENERAL TERMS AND CONDITIONS (GTC)

1. Introductory provisions
1.1. These General Terms and Conditions (hereinafter: GTC) contain the rules and conditions for the use of the Budapest Podcast Studio, which is owned by Takarék Trading Vagyonkezelő kft. (hereinafter: “Studio”).
1.2. By using the Studio, the user (hereinafter referred to as "Client") accepts and undertakes to comply with the GTC.
1.3. The GTC is available on the Studio's website and may be amended at any time. Customers will be notified of the entry into force of the amendments via the website.
2. Using the Studio
2.1. The Studio can only be used by prior reservation and in accordance with the conditions set out in these GTC.
2.2. When using the Studio, the Client is obliged to comply with the safety and operational regulations and to ensure the proper handling of the equipment.
2.3. It is prohibited to use the Studio while intoxicated or under the influence. Clients in this condition will be denied use of the Studio and the booking fee will not be refunded.
2.4. The use of change shoes is mandatory. If the carpet needs cleaning after pick-up, we will charge a cleaning fee.
2.5. It is forbidden to engage in illegal activities or activities that are harmful to the equipment in the studio.
2.6. Pets are not allowed.
3. Rental time and delays
3.1. A reservation Consists of 90 minutes, which 30 minutes of preparation with a studio manager and 60 minutes of recording includes a period of time.
3.2. In case of delay, the pick-up time will be reduced. If additional time is needed and there is no next booking, it can be extended with another full block booking.
3.3. Guests must also be invited to the reserved time, as their participation is required during the 30-minute setup time.
3.4. After the expiration of the rental period, the Clients within 10 minutes at most they have to leave the Studio.
4. Fault reporting and warranty conditions
4.1. Error report:
- Errors can only be reported after the recording is complete and the files have been downloaded.
- aThe bug report must be sent to the email address info@bppodcaststudio.hu.
- The error report must include the date of recording, a detailed description of the errors, and the files with errors.
4.2. Warranty defects:
- In the event of warranty defects, the Studio is obliged to correct the defect as soon as possible or to enable the recording to be re-recorded.
The Customer, who is considered a consumer, is obliged to report the error to the Service Provider by e-mail or in writing within a reasonable time after recognizing it.
If the error can only be corrected by repeating the recording, we will provide this at no additional cost, however, we will not be liable for any consequential damages resulting from the repetition or failure to repeat it. Therefore, if the recording cannot be repeated due to the Customer's fault, we will refund the fee paid.
4.3. Non-warranty defects:
- Defects that are caused by the Customer's fault (e.g. improper microphone use, incorrect settings, significant position changes in front of the camera, loss of focus due to covering the face with hands or other objects) or external circumstances (e.g. power outage, outdoor noise, lack of internet connection, etc.) are not considered warranty defects.
- The Lessor is not responsible for technical and electronic errors occurring during the recording, unless the additional "studio manager during the entire recording" service has been selected.
– for defects resulting from the failure of the Customer's own technical equipment (e.g. own microphone, camera, laptop),
– for content errors in the recording (e.g. corrupted text, uncertainty of characters, dramaturgical problems),
– for the failure of services provided by a third party (e.g. streaming platform error, interruption of internet connection on the service provider's side),
– for loss of time or deterioration in quality resulting from the Customer's late arrival.
5. Sending, storing and downloading files
5.1. After the recordings are completed, our system automatically notifies the Client about the possibility of downloading the files.
5.2. The Service Provider generally uses the recorded raw material Deliver in digital form within 72 hours (download link, file sharing or other means).
The delivery time for cut and post-processed material is usually depending on the package chosen. 5–10 business days, which is an indicative deadlineand may be modified if necessary.
5.2.1. Any further modifications requested by the “Client” shall be made by the “Studio”. 5 working days will repair it internally and send it out. Extra services at a surcharge in this case, this date is after payment It is extended by 5 working days.
5.2.2. The client shall be responsible for the cut versions sent by the “Studio” 14 working days After the 7th working day, the cut version is considered completed by the "Studio" and no further modifications are possible.
5.3. Raw files are stored for 30 days from the date of recording, after which the files will be destroyed or deleted.
6. Payment terms
6.1. The rental fee is the amount specified on the invoice, which does not include extra costs (e.g. extra equipment, late fees, studio manager services, etc.).
6.2. The payment method and deadline are in accordance with the terms and conditions stated on the invoice.
6.3. We can only send the recorded cut and uncut materials after payment.
7. Cancellation and refund
7.1. The Customer may cancel the reservation, but under the following conditions:
- 50% refund if cancelled 48 hours before the start of the rental.
- There is no refund for cancellations made 24 hours before the rental starts.
– A one-time change of time – in consultation with the Service Provider – can be provided free of charge, depending on available capacity.
7.2. The Lessor reserves the right to modify or cancel the rental period if the studio becomes unusable (e.g. technical failure, natural disaster). In such a case, the Client will receive a full refund.
8. Liability and damages
8.1. The Client is responsible for the intended use of the Studio and the equipment.
8.2. In the event of damage or loss of the Studio or equipment, the Client is obliged to compensate for the damage.
8.3. The Studio is not responsible for any accidents or injuries caused by the Client or third parties.
8.4. The Lessor is not responsible for any noise that may occur.
8.5 The Lessor is not responsible for the content of recordings made in the studio. We are unable to accept any claims for damages or compensation for these or other problems (delays, non-warranty defects, loss of reputation, etc.) afterwards.
9. Data protection
9.1. The Studio processes the Clients' personal data solely for the purpose of providing the service and handling error reports.
9.2. A detailed description of data processing can be found in the Privacy Policy available on the Studio's website.
10. Other provisions
10.1. The parties are obliged to first resolve all disputes through negotiations.
10.2. Hungarian laws shall govern any issues not regulated in the GTC.
By using the Studio's website, the Client accepts the contents of the GTC.
